1. Acceptance and eligibility
By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use Treasure Hunt. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.
2. What Treasure Hunt provides
Treasure Hunt is a community-powered tool for finding products, building shopping routes, sharing item sightings, contributing store maps, participating in item hunts, and coordinating an in-Store Runner who picks approved items for an arriving shopper. Features may be experimental, unavailable in some stores, or changed as the Service develops.
Treasure Hunt is not a retailer, delivery service, emergency service, or accessibility-navigation service. Unless we expressly say otherwise, we are not sponsored, approved, or operated by any store, product brand, or property owner shown in the Service.
3. Accounts and security
You may browse some parts of Treasure Hunt without an account. Reporting items, owning lists, participating in hunts, and earning points may require an account. You agree to provide accurate account information, keep your credentials and device secure, and promptly tell us if you believe your account has been compromised.
You may create only accounts you are authorized to use. You are responsible for activity performed through your account until you notify us of unauthorized access. We may refuse a username that is misleading, impersonates another person, infringes rights, or violates these Terms.
Runner access is a revocable account capability limited to approved Stores. Runners must provide accurate availability, follow the item's pre-authorized fulfillment rules, prepare the required disposable bags, handwrite the displayed order and bag labels, place each item in its assigned bag, and complete only verified handoffs. Sharing assignments, handoff codes, or operational account access is prohibited.
4. Community information is not guaranteed
Product locations, prices, availability, routes, floor labels, store maps, accessibility information, and opening details may come from community members or third parties. They may be inaccurate, incomplete, delayed, or outdated. Always rely on posted store signs, employee instructions, your surroundings, and your own judgment.
A route is only a convenience. It does not guarantee that a path is open, safe, accessible, or permitted, or that a product is in stock. Do not use the app while walking in a way that distracts you from people, carts, shelving, stairs, traffic, or other hazards.
5. Store rules and personal safety
When using Treasure Hunt, you agree to:
- follow all store policies, signs, and employee instructions;
- remain in areas open to the public;
- not trespass, obstruct aisles, climb fixtures, or create a hazard;
- stop mapping or photographing if a store asks you to stop;
- not photograph people, payment cards, receipts containing personal information, security systems, employee-only materials, or confidential information; and
- use location, camera, and physical-activity features only when it is safe and lawful to do so.
6. Your contributions
“Contributions” include photos, product information, prices, store suggestions, notes, map points, landmark labels, and other material you submit. You retain any ownership rights you have in your Contributions.
You give M3 Platform a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and use your Contributions to operate, secure, improve, promote, and provide the Service. This license continues for Contributions already shared with the community even if you stop using the Service, unless we delete the Contribution.
You represent that:
- you have the rights and permissions needed to submit the Contribution;
- the Contribution is accurate to the best of your knowledge;
- it does not violate privacy, intellectual-property, publicity, or other rights;
- it is not deceptive, unlawful, threatening, hateful, sexually explicit, or malicious; and
- it does not contain malware, hidden tracking, or attempts to manipulate the Service.
We may review, edit, decline, hide, or remove a Contribution, but we are not required to monitor every Contribution.
7. Acceptable use
You may not:
- submit false locations, fake sightings, duplicate reports, or manipulated evidence;
- use automation, scraping, bots, or reverse engineering except where applicable law expressly permits it;
- interfere with the Service, bypass security or usage limits, or probe for vulnerabilities without written permission;
- use the Service to stalk, track, identify, or harm another person;
- collect other users’ information or use Contributions to build a competing database; or
- use the Service or its content for an unlawful purpose.
8. Fees, Store purchases, points, hunts, and rewards
When Runner fulfillment is available, Treasure Hunt may charge a commitment or service fee when you submit an order. The fee may be a fixed amount or a percentage of the displayed estimated merchandise subtotal, subject to displayed minimum or maximum amounts. We show the fee, calculation basis, and applicable cancellation or refund terms before you commit. This fee pays for the Treasure Hunt service; it is separate from and is not a deposit toward the Store merchandise unless an offer expressly says otherwise.
After picking, you review the actual-item manifest and pay for merchandise through the Store's designated payment provider. The Store or its provider, not Treasure Hunt, processes that purchase and your card details. Prices, stock, weights, taxes, provider availability, and acceptance of a transaction remain subject to the Store. A client redirect or screenshot is not proof of payment; handoff requires provider-confirmed payment and a valid, unexpired one-time code.
If you cancel, do not arrive, reject a compliant manifest, or are unavailable at handoff, the fee treatment shown in the accepted quote applies. Store, Runner, or platform failure is handled under that same displayed policy. Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.
Points, hunts, discounts, free items, or other rewards are available only when the Service expressly offers them. Unless the specific offer says otherwise, points have no cash value, are not property, cannot be transferred or sold, and may expire.
Additional rules shown with a hunt or reward become part of these Terms. We may verify eligibility and submissions, correct errors, reverse points, reject fraudulent activity, or modify or end a reward program as permitted by law. A displayed preview, sample balance, or planned feature is not a promise of payment or a reward.
9. Our content and software
The Service, excluding your Contributions, is owned by or licensed to M3 Platform and is protected by intellectual-property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose and in accordance with these Terms.
Store names, logos, product names, and other third-party marks belong to their respective owners. Their appearance does not imply endorsement or affiliation.
10. Privacy and permissions
Our Privacy Policy explains how we handle information. Some features require Android permissions, including precise location or physical-activity access. If you explicitly start a fulfillment trip, an ongoing Android notification shows while the app temporarily updates your arrival estimate. You may decline those permissions or stop the trip; manual arrival may be available, while other related features will not work.
11. Third-party services
The Service may depend on or link to third-party services, websites, app stores, mapping tools, payment providers, or retailers. Their terms and privacy practices govern your use of their services. We are not responsible for third-party content, products, availability, or conduct.
12. Service changes and termination
We may add, change, suspend, or discontinue features. We may limit access to the Service or remove Contributions when reasonably necessary to protect users, stores, M3 Platform, or the Service; enforce these Terms; or comply with law.
You may stop using the Service and uninstall the app at any time. Uninstalling does not automatically delete Contributions already submitted. See the Privacy Policy for deletion requests.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” M3 Platform disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, safety, and reliability.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, M3 Platform and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, rewards, goodwill, or business opportunities, arising from or related to the Service.
To the fullest extent permitted by law, our total liability for claims relating to the Service will not exceed the greater of US$100 or the amount you paid us to use the Service during the twelve months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
15. Responsibility for claims
To the extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs arising from your unlawful use of the Service, your Contributions, or your material breach of these Terms. This section does not require you to cover a claim caused by M3 Platform’s own unlawful conduct.
16. General terms
If part of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or business transaction. Applicable law and courts with proper jurisdiction will govern disputes, without waiving any consumer protection that cannot legally be waived.
17. Changes to these Terms
We may update these Terms as the Service changes. We will post the revised Terms here and update the effective date. If a change is material, we will provide additional notice when reasonably practical. Continued use after updated Terms take effect means you accept them.
